ABOUT INTELECTUAL AND PROPERTY RIGHTS
KEPPE & PACHECO ASSOCIATION (“Keppe & Pacheco”) by means of its Virtual Store located at the web address www.keppepacheco.com/loja (“Virtual Store”) authorizes the End User to purchase products related to Keppe & Pacheco, including, but not limited to books, manuals, DVD, CD, KIT (hereinafter just referred to as “Products”) or to pay the services carried out by Keppe & Pacheco or related companies (“Services).
The purchase of Products in the Virtual Store does not refer to, on any grounds whatsoever, any event of assignment of property or entitlement of the rights for the Products. Keppe & Pacheco shall continue to be the sole titleholder of the rights of the Products. Keppe & Pacheco shall remain the sole and exclusive titleholder of the moral and patrimonial rights of the Products, as well as the titleholder of all (printed or virtual) explanatory material produced by it regarding the subject product. The End User is aware that the noncompliance of this obligation will authorize Keppe & Pacheco to take judicial and extrajudicial measures it might deem feasible to defend its rights.
The End User shall use the Products exclusively for his private and noncommercial use, being absolutely prohibited the commercial use of the Products, the method used in it, the final product resulting from the application of the method or any other means resulting from the attainment of profits by the End User as a result of the direct or indirect application of the Products available to him by Keppe & Pacheco.
Any modification, translation, reproduction, lending, rental, resale, cession, assignment or any other form of making these Products available to third parties, as well as any other materials which might come to be made available to the End User by Keppe & Pacheco in the future is forbidden.
Keppe & Pacheco shall not be responsible for damages resulting from by the End User's malpractice or want of caution at handling the material or applying the procedure to assemble the Product, whenever applicable. Nor shall Keppe & Pacheco be responsible for results other than those provisioned in the Products, or occasional damages resulting from the replacement of the material originally suggested by other of different quality, quantity and/or technical specification, whenever applicable.
ABOUT PAYMENT
Keppe & Pacheco will charge you for the purchase of Products the amount available in the Virtual Store at the moment of the purchase. Payment may be made by the means described in the section CONDITIONS OF PAYMENT in this Virtual Store.
THE SUPPORT TO THE END USER
Keppe & Pacheco shall make available to the End User the Customer Service to clarify technical queries related to the download and delivery of the Products, clarifying queries that might come up during the procedure.
ABOUT GENERAL INFORMATION
The commercial relation between the Final User and Keppe & Pacheco, carried out by the purchasing of the Products or by the payment of Services in the Virtual Store creates no other bond on the part of Keppe & Pacheco further than those explicitly set forth hereby.
ABOUT THE LIMITATION OF RESPONSIBILITY
Within the maximum strictness allowed by applicable legislation, Keppe & Pacheco, its affiliates or employees shall not be, under no circumstance, held responsible for loss profits, loss of income, sales or commodity purchase costs, damage to property, bodily injuries or any direct, indirect or incidental damages, regardless the way they were caused or as a result of contracts, appeal, negligence or other guilty modality stemming from the malpractice handling of the Products purchased in the Virtual Store.
The limitations of the above mentioned device do not harm the consumer's statutory rights nor exempts or limits Keppe & Pacheco's responsibilities towards the End User in case of damage resulting from its negligence.
